Buffalo Bills 50th Season Prize Package Promotion
BUFFALO BILLS 50th SEASON PRIZE PACKAGE SWEEPSTAKES ("Sweepstakes") OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. To Enter:
The Sweepstakes begins 4/24/09 at 12:00 a.m. (EST) and ends 8/14/09 ("Sweepstakes Period"). There are two (2) ways to enter: 1) Internet Entry: Simply log onto the Buffalo Bills 50th Season Web Experience home page [bills50.com] and register using your name and email address. Only one entry per person and email address will be accepted. The Bills are not responsible for incorrect or inaccurate entry information whether caused by technical difficulty or human error, which may occur in the processing of the entries. 2) Mail Entry: To enter by mail, hand-print your name, address, city, state, zip, day and evening phone numbers, your email address (if available) and the words "Buffalo Bills 50th Season Prize Package Sweepstakes" on a 3" x 5" card and mail it in a stamped envelope addressed to One Bills Drive, Orchard Park, New York 14127, Attention: 50th Season Prize Package Sweepstakes. Only one mail-in entry per person and only one entry per stamped envelope will be accepted. Any incomplete, mechanically or mass produced or reproduced entries will be disqualified. To be eligible, mail-in entries must be received no later than 8/14/09. The first eligible entry received by the Sponsors will be deemed to be the only entry recognized for that person.
The Sponsor will not verify receipt of entries. All entries submitted become the property of Bills and will not be returned. Method of entry will not affect your chances of winning. The odds of winning will depend on the number of Eligible Entries received.
2. Eligibility:
The Sweepstakes is open to anyone 13 years of age and older as of March 31, 2009. If a prize is won by an eligible entrant under the age of 18 as of 4/24/09 ("Minor"), the prize will be awarded to the Minor's parent or legal guardian who must sign and return all required documentation as described in these Official Rules. The following persons are not eligible to enter the Sweepstakes: (a) Employees of the Buffalo Bills, and their affiliates, subsidiaries, advertising, promotion and other agencies, and each of their respective officers, directors, employees, representatives and agents (collectively, "Sweepstakes Entities"), and (b) any immediate family members of any Sweepstakes Entities, whether living in the same household or not, and (c) anyone living in the same household, whether related or not. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension. Sweepstakes Internet entries will be deemed made by natural person named in the entry and, if there is a dispute, the authorized holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by the Internet access provider or the domain associated with the submitted e-mail address. All federal, state, and local laws and regulations apply. By participating, you agree to these Official Rules and to the decisions of the Sponsors, which are final and binding in all respects. THE SWEEPSTAKES IS VOID WHEREVER PROHIBITED BY LAW, RULE, REGULATION OR ORDINANCE.
3. Grand Prize:
Only one grand prize will be awarded, and will be comprised of the following: Bills 50th Season prize package. Details to be determined. Check back for updates.
4. Winner Selection:
Grand Prize. Grand Prize winner will be drawn by the Buffalo Bills on or about 8/14/09 from all Eligible Entries, as described above, submitted during the Sweepstakes Period. Actual odds of winning the prize depend upon the number of eligible entries received.
5. Grand Prize Conditions:
Winner will be notified by telephone or e-mail, and will be required to complete and sign an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release ("Affidavit/Release"). Such documents must be returned by the date and/or time indicated within such documents. If the potential winner fails to return such documents within that time, or if an entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential winner will be disqualified and an alternate winner will be selected at random from all remaining Eligible Entries. If the winner is a Minor, the winner must be accompanied by the parent or legal guardian (identified in the Affidavit /Release) to whom the prize is awarded, to the events described in section 3 when exact prize package is determined. If prize or prize notification is returned as undeliverable, this will result in disqualification and an alternate winner will be selected at random from all remaining Eligible Entries. All federal, state or other tax liabilities (including income taxes) arising from this Sweepstakes will be the sole responsibility of the winner. The winner may be required to sign an IRS W-9 or its equivalent. Except where prohibited by law, the winner's entry and acceptance of the prize constitutes permission for the Sweepstakes Entities to use said winner's name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. Prizes are not redeemable for cash, are nontransferable, and no substitutions are allowed except by Sponsor who reserves the right to award a prize of equal or greater ERV if the advertised prize is unavailable.
6. Additional Terms:
By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor, which shall be final in all respects, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. The winner and entrants also agree to release, discharge, indemnify and hold harmless Sweepstakes Entities from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes.
7. Limitations of Liability:
Sweepstakes Entities are not responsible for late, lost, damaged, misdirected, incorrectly addressed, incomplete, illegible, inaccurate, undeliverable, destroyed, duplicate, or postage-due mail entries or requests for a list of winners, and/or lost, late, misdirected, undeliverable or incomplete Internet entries due to system errors and failures, or faulty transmissions or other telecommunications malfunctions and/or Internet entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, or faulty transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or providers, computer equipment, or entries not received by Sponsor on account of technical problems or traffic congestion on the Internet, or at a website, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from entering the Sweepstakes or downloading any material for the Sweepstakes or from buffalobills.com or bills50.com, or other telecommunications malfunctions which may limit an entrant's ability to participate. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception (including the use of automated quick entry programs) or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants, Sponsor, or Sweepstakes Entities. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. If by reason of a printing or other error, more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available. No more than the advertised number of prizes will be awarded. In no event will the Sweepstakes Entities be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, or punitive damages arising out of access to and use of the bills50.com or buffalobills.com web sites or the downloading from and/or printing material downloaded from said sites. Without limiting the foregoing, the Sweepstakes is provided "AS IS" without representation or warranty of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or noninfringement. Some jurisdictions may not allow the limitations or exclusions of liability for incidental or consequential damages, or exclusion of implied warranties, so some of the aforementioned limitations or exclusions may not apply. Check local laws for any restrictions or conditions regarding these limitations and/or exclusions.
8. Sponsors:
The Sponsor shall mean Buffalo Bills, One Bills Drive, Orchard Park, New York 14127. The National Football League is not a sponsor of, nor a partner in, this Sweepstakes.
9. Winners List:
For the name(s) of the winner(s), mail a self-addressed, stamped envelope to Buffalo Bills 50th Season Prize Package Sweepstakes, One Bills Drive, Orchard Park, New York 14127, Attention Buffalo Bills 50th Season Prize Package Sweepstakes Winners List. Requests must be received no later than 8/14/09.
